Thank you for your interest in using Choovie, a cinema ticket service owned by Choose Entertainment (ACN 607 493 498) (we, our, us). Choovie allows customers to access and purchase surplus cinema tickets from participating cinemas at prices based on real time supply and demand and receive notifications based on ticket price, location, date & time and movie preferences (Services). All cinema tickets are purchased from a participating cinema and are subject to the cinema’s terms and conditions.
Terms and Conditions of Use
Access and Accounts
To access and use Choovie you will need to:
- Download the Choovie app from the Apple App (IOS) or Google Play Store’s (Android) (Choovie App); or
- Visit www.choovie.com.au (Choovie Website), and register for a Choovie account or enter as a guest.
To obtain a cinema ticket you must pay for your chosen movie ticket via the Choovie App or Choovie Website to receive a QR Code — which is your cinema ticket (Choovie ticket). You can purchase a single Choovie ticket or buy multiple Choovie tickets for friends and family. You can either print the Choovie ticket or use the ticket in electronic format from your smart phone (email or Choovie wallet). You must present your Choovie ticket to the cinema for admittance.
You can only use your Choovie ticket for your chosen cinema venue, session and movie, and each Choovie ticket expires after one use. If you suspect that your Choovie account has been compromised in any way, you should: i) change your password at the Choovie website / app; and ii) notify Choovie immediately.
Choovie may suspend or terminate your access to Choovie at any time if it suspects any misuse of the Services, or if you breach these terms and conditions.
Participating Cinemas
Choovie tickets are only available at participating cinemas, who set the price and availability of their cinemas tickets. We have no control over the availability, price of cinema tickets or allocation of seating and each Choovie ticket is subject to the terms of the participating cinema. As such, we cannot guarantee that those who have purchased multiple tickets will be seated together.
Cancellations and Refund Policy
Our participating cinemas may sell Choovie tickets at a significant discount to those available at the box office. Once a Choovie order has been confirmed it cannot be changed or cancelled and refunds will not be provided. You are responsible for taking care to review your order before completing the payment process to ensure that all details are correct, especially the email address to which your Choovie tickets will be delivered.
On rare occasions a cinema may cancel or change a planned movie session to which Choovie tickets have been sold. While we are not responsible for cinema cancellations or changes we will use our reasonable endeavours to provide you notice of cancelations and changes prior to the planned session time.
If a cinema cancels or changes a planned session time:
- Choovie account holders will have a Choovie credit added to their Choovie Wallet to the equal value of the Choovie ticket purchased, valid for a 12 month period from the time of cancelation.
- Choovie guests will receive an email informing them of the cancelation or change with a link to subscribe as a Choovie account holder and receive a Choovie credit in their Choovie Wallet as above.
Any special offers and credits in your Choovie Wallet are non-refundable and will expire on the date stated on the offer or credit.
Disclaimer and Liability
We are not an agent, representative or affiliate of, any participating cinema. We provide no warranty or representation on the accuracy, completeness or correctness of any information provided by participating cinemas or regarding the availability, quality, merchantability or the like, of the products supplied by participating cinemas.
We make all reasonable efforts to ensure that our Services are available to you at all times, however there may be times when our Services are not available due to technical reasons or reasons beyond our control.
To the extent permitted by law and not excluding Australian Consumer Law, we exclude liability for any loss or damage suffered by anyone in connection with the access, use, misuse or unavailability of our Services.
Security Policy
Choovie uses the eWAY gateway for online credit card transactions. eWAY process online credit card transactions for thousands of Australian merchants, providing safe and secure means of collecting payments via the internet. All transactions performed using the eWAY gateway are secured payments:
- Payments are fully automated with an immediate response
- Your credit card and login details cannot be viewed by us or any outside party
- All transactions are performed under 128 Bit SSL Certificate
- All transaction data is encrypted for storage within eWAY’s bank-grade centre, further protecting your credit card data
- eWAY are authorised third party processor for all the major Australian banks
- eWAY does not hold or possess your funds; all monies are directly transferred from your credit card to the merchant account held by us.
General
If any part of these terms and conditions are determined to be illegal, invalid or otherwise unenforceable or void, that part shall be severed to the extent necessary and the remainder of these terms and conditions shall continue in full force and effect. No waiver of any breach of these terms and conditions will be construed as a waiver of any other breach of these terms and conditions.
